In re Estate of Ann Lucas, Deceased.

Be it remembered that on the 19th day of April 1919 it being the eighteenth day of march 1919 term of the District Court of the State of Iowa in and for Emmet County, the will of Ann Lucas was duely admitted to probate, a true, correct and complete record of which is now entered herein with certificate of probate thereon in words and figures as follows, to wit:

LAST WILL AND TESTAMENT

I, Ann Lucas, of the town of Estherville, County of Emmet, State of Iowa, do make this my last will and testament, and hereby revoke all former wills by me at any time made.

1st. I direct payment of all my debts.
2nd. I give, devise and bequeath all other property, real and personal, which I amy own at the time of my death, as follows, that is to say:

Paragraph 1.

To my son Silas I give one dollar.

Paragraph 2.

To my grand-daughter Ruth, the daughter of my son Silas, I give my gold watch and chain, and in case Ruth should die before me, I give this gold watch and chain to the next oldest daughter of my son Silas.

Paragraph 3.

To my grandson Frank, the son of Eliza Jenkins, I give one-twenty fourth share of all the real and personal property that may be left after the payment of my debts.

Paragraph 4.

All the rest of my property, real and personal, I give, devise and bequeath in eleven equal shares as follows:

(1) To my son James Walter, I give one-eleventh share of said property.
(2) To my son John, I give one-eleventh share of said property.
(3) To my son Daniel, I give one-eleventh share of said property.
(4) To my son Charles, I give one-eleventh share of said property.
(5) To my daughter Mrs. Eliza Jenkins, I give one-eleventh share of said property.
(6) To my daughter Betsey, I give one-eleventh share of said property.
(7) To my daughter Mrs. Hayes, I give one-eleventh share of said property.
(8) To my daughter Caroline Allen, I give one-eleventh share of said property.
(9) To my daughter Miranda Allen, I give one-eleventh share of said property.
(10) To my daughter Elva Allen, I give one-eleventh share of said property.

And the remaining one-eleventh share of my said property, I give and bequeath to the wife and children of my son Silas as follows:

(a) To the wife of my son Silas, I give one-third interest and portion of said one-eleventh share of my said property.
(b) To the children of my son Silas, I give two-thirds interest and portion of said one-eleventh share of my said property.

Paragraph 5.

In the case of death of either of the persons named in the foregoing will and testament, it is my will that the share that I have here in given to such person, shall go to such person’s children.

Paragraph 6.

I hereby nominate my son James Walter Lucas to be the executor of my last will and testament.

In witness whereof, I have to this, my last will and testament, consisting of three sheets of paper, subscribed my name this the 22nd day of June 1910.

We hereby certify that on this the 22nd day of June, 1910, at Estherville, in Emmet County, Iowa, Ann Lucas, to us personally known, did, in our presence, sign the foregoing instrument and declare the same to be her last will and testament; and that at her request, and in her presence, and in the presence of each other, do hereunto subscribe our names as witnesses thereto.

CERTIFICATE OF PROBATE OF WILL

I, Sidney E. Bemis, Clerk of the District Court in and for said County and State, as hereby certify that on the 19th day of April 1919 the will of Ann Lucas deceased, to which this certificate is annexed, which is dated June 22, 1910, was duly admitted for probate by said Court as and for the last will and testament of the said decedent.

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of said Court this 19th day of April 1919.
