Record and Pension Office, War Department. Respectfully returned to the
Commissioner of Pensions. James O. Gates Co. F, 4 Reg't Iowa Cavy was enrolled
Jany 5, 1864 and M.O. Aug 8, 1865...From Enl. 186-, to m.o. 186-he held the rank of
pvt and during the period the rolls show him present except as follows "June 3 to
6 absent in camp. Oct 31 on expedition since Sept 1/64. Feby 28/65 Detached as

"enlisted Jany 25, 1864, and served as a pvt in Co. F, 4 Reg't Ia Vol Cav.
...discharged Aug 8, 1865."
"James O. Gates mentioned in the preceding indorsement, was enrolled jany 5, 1864,
and mustered out with Co. Aug 8, 1865 at Atlanta, Ga."

Certificate No. 387121, Class Widow, Pensioner Josephine Gates, Soldier James O,
Service Pt F. 4 Ia Cav. The Commissioner of Pensions: SIR: I have the honor to
report that the above-named pensioner who was last paid at $8, to 4 Aug 1902 has
been dropped because of Death date of death not given. Very respectfully, /s/
United States Pension Agent.

Certificate of Marriage Record. State of Iowa, Wapello County}ss. I, C.E. Norton,
clerk of the District Court in and for said County, do hereby certify that James
O. Gates and Josephine Watson were joined in marriage by Joseph Berkey a Justice
of the Peace on the 2 nd day of March A.D. 1871, as appears from the Marriage
Records now in my office. Witness my hand and the Seal of said Court this 12 th

GENERAL AFFIDAVIT. State of Kansas, County of Crawford, ss:
In the matter of Pension claim of Josephine Gates ON THIS 30" day of March A.D.
1891; personally appeared before me a Notary Public in and for the aforesaid
County duly authorized to administer oaths, Martha Alexander aged 60 years, a
resident of Brazilton in the County of Crawford and State of Kansas whose Post
Office address is Brazilton Crawford Co Kansas Martha Anderson aged 60 years, a
resident of [blank] in the County of Crawford and State of Kansas whose Post
Office address is Brazilton well known to me to be reputable and entitled to
credit, and who, being duly sworn, declared in relation to aforesaid case as
follows: That she was present at the house of James Gates in Crawford County
Kansas on the 15 th day of December 1884. That at that time and place his wife
Josephine Gates gave birth to a child which was afterward named Loney E. Gates.
She further declares that She has no interest in said case and is not concerned in
its prosecution. Affiant /s/ Martha J. Alexander.

GENERAL AFFIDAVIT. State of Kansas, County of Crawford, ss:
In the matter of Pension claim of Josephine Gates ON THIS 23 day of March A.D.
1891; personally appeared before me a Notary Public in and for the aforesaid
County duly authorized to administer oaths, Emma Pollard aged 19 years, a resident
of Midway in the County of Crawford and State of Kansas whose Post Office address
is Brazilton Crawford Co Kansas Martha Anderson aged 60 years, a resident of
Midway in the County of Crawford and State of Kansas whose Post Office address is
Midway Kansas well known to me to be reputable and entitled to credit, and who,
being duly sworn, declared in relation to aforesaid case as follows: That she was
present at the house of James O Gates late of Co. F. 4th Iowa Cavalry on the 15th
day of December 1884 at Brazilton Kansas in Crawfor County. That at that time his
wife Josephine Gates gave birth to a female child. That said child was named Loney
E. Gates. That said child of James O & Josephine Gates is yet living and dependent
on her mother for support. She further declares that She has no interest in said
case and is not concerned in its prosecution. Affiant /s/ Emma Pollard.

GENERAL AFFIDAVIT. State of Kansas, County of Crawford, ss:
In the matter of Pension claim of Josephine Gates widow of James O. Gates Late of
4 th Ia Cav ON THIS 18 day of July A.D. 1892; personally appeared before me a
Notary Public in and for the aforesaid County duly authorized to administer oaths,
Melissa Hicks aged 29 years, a resident of Fort Scott in the County of Bourbon and
State of Kansas whose Post Office address is Fort Scott Kan well known to me to be
reputable and entitled to credit, and who, being duly sworn, declared in relation
to aforesaid case as follows: That she was present at the death of her father
James P. Watson near Eddyville in the cunty of Mahaska state of Iowa on the 11 th
day of September 1869. That she remembers well how he was dressed for burial and
that my mother (now the widow of James O. Gates) was so overcome with grief that
she had to be lifted from the wagon. That she went to the burial and saw her
father James P Watson buried at said time & place and although not seven years old
at the time she remembers well the above facts. She further declares that she has
no interest in said case and is not concerned in its prosecution. Affiant /s/

Co F 4th Ia Cav. AFFIDAVIT OF Levi Gates #453,047, "death of first wife" filed by

GENERAL AFFIDAVIT. Iowa, County of Wapello, ss: In the matter of Pension Claim of
Josephine Gates Widow of James O Gates ON THIS [blank] day of Nov A.D. 18 ;
personally appeared before me W.S. Coen Notary Public in and for the aforesaid
County duly authorized to administer oaths, Levi Gates aged 53 years, a resident
of Bedwell in the County of Wapello and State of Iowa well known to me to be
reputable and entitled to credit, and who, being duly sworn, declared in relation
to aforesaid case as follows: That he was acquainted with Lucinda Gates first wife
of James O Gates. That she died on the 17 th day of August 1868 at or near
Marysville in Monroe County State of Iowa, that at the time of the death of
Lucinda Gates the Residence of James O Gates and Lucinda Gate was in Moneroe Co
Iowa their Post office of said Gates was Marysville Monroe Co Iowa that I am a
brother of James O Gates deceased. His Post Office address is Bidwell Wapello Co
Iowa he further declares that he has no interest in said case and is not concerned
in its prosecution. Affiant /s/ Levi Gates.

Cav. AFFIDAVIT OF Mary E. Klingensmith #453,047, filed by Soule & Co. Attorneys,
Washington, D.C.
GENERAL AFFIDAVIT. Kansas County of Comanche, ss: In the matter of pension claim
of Josephine Gates #453047 ON THIS 6 day of January A.D. 1893; personally appeared
before me a Justice of the Peace in and for the aforesaid County duly authorized
to administer oaths, Mary Klingensmith aged 33 years, a resident of Avilla
Township in the County of Comanche and State of Kansas well known to me to be
reputable and entitled to credit, and who, being duly sworn, declared in relation
to aforesaid case as follows: That Iknow of my own personal Knowledge of the death
of Lucinda Gates the wife of Jams O Gates and that she died at Eldorado Iowa and
was buried on the 18" day of 1868 and that I know this to be true because I was
present at the time of her death. Her Post Office address is Arville Comanche Co
Kansas and I further declare that I have no interest in said case and am not
concerned in its prosecution. Affiant /s/ Mary E. Klingensmith.
STATE OF Kansas, COUNTY OF Comanche, ss: Sworn to and subscribed before me this
day by the above-named affiant, and I certify that I read said affidavit to said
affiant, and acquainted with its contents before she executed the same. I further

Affidavit that the Claimant has not Re-married, and that She is without other
means of Support than her Daily Labor. CLAIM OF Mrs. Josephine Gates widow of Jas.
O. Gates Co F, 4 th Reg't Iowa Cav. Volunteers. Widow's Pension N. 453,047.
WE, James W. Champion and Moses W. Hall of the town of Pittsburg County of
Crawford and the State of Kansas do solemnly swear that we are neighbors of
Josephine Gates who is the widow of James O Gates, deceased, on whose account she
applies for Pension under the provisions of the Act of June 27, 1890, and that for
the past two years we have been well acquainted with the said Josephine Gates;
that from our frequent intercourse and conversations, and from other
circumstances, we have every reason to believe, and we do believe, that the said
Josephine Gates has not re-married since the death of the above-mentioned James O
Gates. Affiants /s/ James W. Champion and Moses W. Hall
Sworn to and subscribed before me this 22 day of November, 1890. I have no
interest in the prosecution of this claim for pension. /s/ A.J. Georgia Notary

In the matter of pension claim of Josephine Gates ON THIS 5 day of November A.D.
1892; personally appeared before me a Notary Public in and for the aforesaid
County duly authorized to administer oaths, Josephine Gates aged 49 years, a
resident of Pittsburg in the County of Crawford and State of Kansas well known to
me to be reputable and entitled to credit, and who, being duly sworn, declared in
relation to aforesaid case as follows: That the name of my late husband is James
Oliver Gates, and that he always signed his name James O. Gates. That in her
application for pension and proof of claim she supposed the name had always been
written James O. Gates. Her Post Office address is Midway Kansas (Crawford Co)
Affiant /s/ Josephine Gates.

STATE OF Kansas, COUNTY OF Crawford, ss: Sworn to and subscribed before me this
day by the above-named affiant, and I certify that I read said affidavit to said
affiant, and acquainted her with its contents before she executed the same. I
further certify that I am in nowise interested in said case, nor am I concerned in

Rate, $8 per month, commencing August 12 1890, and $2 per month additional for
each child, as follows:

$8 commencing Aug 12, 1890. DEAD. Additional sum of $2 per month for each of the
following children, until arriving at the age of 16 years, commencing Aug. 12,
1890:

State of Kansas, County of Crawford, ss: ON THIS 14 th day of Nov A.D. on thousand
eight hundred and ninety - personally appeared before me a Notary Public with in
and for the County and State aforesaid O.T. Lewis, who, being duly sworn according
to las, declares that he resides in Hepler County of Crawford State of Kansas; and
that he is a practicing Physician of Said County of said County of Crawford
located in Hepler in the last-named County and That he was present at the home of
Jas Gates Late of Co. F of 4 th Iowa Cavalry on the 28 th day of November 1882 and
then and there delivered a male child That said child was alive and so far as I
know is yet alive
Affiant further declares that he has no interest in the prosecution of any claim
in behalf of Josephine Gates for Pension. /s/ O.F. Lewis M.D.

GENERAL AFFIDAVIT. State of Kansas, County of Crawford, ss:
In the matter of pension claim of #453047 Josephine Gates widow of James O. Gates
ON THIS 29 day of June A.D. 1892; personally appeared before me a Notary Public in
and for the aforesaid County duly authorized to administer oaths, Louisa Watson
aged 25 years, a resident of Pittsburg in the County of Crawford and State of
Kansas whose Post Office address is Pittsburg Kansas Emma Poolard aged 23 years, a
resident of Pittsburg in the County of Crawford and the State of Kansas well known
to me to be reputable and entitled to credit, and who, being duly sworn, declared
in relation to aforesaid case as follows: That she is well acquainted with the
financial condition of claimant and knows that claimant has no income or means of
support except such as her own labor or the labor of her children That her
property consists of four cows and a team and she rents land for crops which is
cultivated by her and her daughter who go into the fields and work like men to
tend the crops That she has no notes bonds mortgages or other property that would
bring her an income That she does not own any land or other propery except as
above stated and a few farm implements. They further declare that she has no
interest in said case and is not concerned in its prosecution. Affiant /s/ Louisa

day by the above-named affiant, and I certify that I read said affidavit to said

Record Proof of Soldier's Death. Claim of Josephine Gates. RECORD PROOF OF DEATH
OF SOLDIER. State of Kansas, County of Crawford, ss: ON THIS 22 day of Nov A.D.
one thousand eight hundred and ninety - personally appeared before me a Notary
Public within and for the Countyand State aforesaid in Pittsburg County of
Crawford State of Kansas; and that he is a practicing Physician of the County of
Crawford located in Pittsburg in the last-named County, and That he attended James
O. Gates during his last sickness as such physician That the said James O. Gates
died February 2 nd 1890 while under my care
Affiant further declares that he has no interest in the prosecution of any claim
in behalf of Josephine Gates for Pension. Affiant /s/ Wm Williams.
