Last Will and Testament of Herman Joseph Wenzel, 1909

I, Herman Joseph Wenzel, of Viola Township, County of Sac, and State of Iowa, do make this my last will and testament, hereby revoking all wills by me at any time made.

I give, devise and bequeath all my property, real and personal, which I may own at the time of my death as follows, that is to say:

It is my will that all of my just debts, including the expenses of my illness and funeral be paid.

To my wife Barbara Anna Wenzel I give the use of all the property I may own at the time of my death, in lieu of the portion given her by law, as long as she shall live and remain unmarried, subject to the payment to my eldest son John Edward Wenzel of the sum of Two Hundred and Fifty ($250.00) Dollars per annum from the time he became of age, until such time as he shall leave home, and begin a business on his own behalf. Said sum shall be to my said son in cash, and shall be in addition to any sum or sums he may have received heretofore.

At the death of my said wife Barbara Anna Wenzel, I devise and bequeath to my sons John Edward Wenzel, and George John Wenzel, and to my daughters Anna Mary Wenzel, Mary Barbara Wenzel and Theresa Barbara Wenzel all the remainder and residue of my estate, both real and personal, not heretofore disposed of in equal portions, that remain at the time of my wife's death. Should my said wife Barbara Anna Wenzel intermarry with any other man after my death, then and in that case she shall receive absolutely as her share of my estate one third of all the property I may die possessed or seized of, in lieu of the portion given her by law, and after all my just debts shall have been paid the remainder and residue of my estate remaining, after the payment to my said son John Edward Wenzel of the sum of money to be to him, shall be divided between all my said sons and daughters enumerated herein.

I nominate my wife Barbara Anna Wenzel to be executor without bond.

In witness whereof I have to this, my Iast will and testament, consisting of one sheet of paper, subscribed my name this second day of November, 1909.

We hereby certify that on this second day of November, 1909, at Wall Lake, in the County of Sac and State of Iowa, Herman Joseph Wenzel, to us personally known, did, in our presence, sign the foregoing instument, and declare the same to be his last will and testament; and we, at his request, and in his presence, and in the presence of each other, do hereunto subscribe our names hereto.

AFFIDAVIT OF DECEASE.
State of Iowa, Sac County:

I, Barbara Wenzel, do solemnly swear that I was the wife of Herman Joseph Wenzel during his lifetime, and that he departed this life at Carroll, Crawford County, in the State of Iowa, on the fifth day of January, A.D. 1910.

Subscribed in my presence by the said Barbara Wenzel and by her sworn before me this 18th day of February A.D. 1910.
