The plaintiff held an insurance policy in the defendant company on his life stock, and alleges that on Oct. l0, l90l, two of his mules worth $200 were killed by lightning. His policy provided that not more than $75 should be paid on any one animal, so defendant filed proof of his loss with claim for $l50, but the company has failed to make a settlement with him, so suit is brought for $l50.
