Last Will of John Koth
Be it remembered that I, John Koth of Diamond Twp. in the County of Cherokee and State of Iowa hereby revoking all former wills by me made do make this my last Will and Testament in manner following, that is to say:

1st. I direct that my just debts be paid with all convenient speed.

2nd. It is my will and I do bequeath and devise all the residue of my estate real, personal and mixed wheresoever it may be found and of whatsoever it may consist unto my said wife Henrietta Koth and empower her to make all the necessary steps there is to be made for the purpose of making loans to pay her debts but it shall be so controlled and in such a manner and shape as to beneft the said estate of which I may die as the owner.

3rd. It is my will that the remainder of my estate real and personal or mixed after the decease of my said wife shall go to Henry Knauber the husband of my said oldest daughter who shall at the time of the occupancy of said estate pay to my youngest daughter Bertha Koth the sum of Five Hundred Dollars but the same shall not be paid before the year eighteen hundred and ninety nine (1899) as herein expressed by the said testator.

4th. I order and direct that at the decease of my daughter's husband or herself said estate shall go to their issues share and share alike after having attained the age of eighteen and twenty years.

IN WITNESS WHEREOF I the above named testator have hereunto set my hand and seal this 10th day of October in the year of our Lord Eighteen Hundred and ninety four 1894.

Then and there signed, sealed and published by John Koth the testator as and for his last will in the presence of us who at his request in his presence and im presence of each other have here to set our names as witnesses.

I, E. J. Hornibrook, Clerk of the District Court of the State of Iowa, in and for Cherokee County, do hereby certify that the foregoing Last Will and Testament of John Koth deceased, was on the 8th day of January 1901, duly proved and admitted to probate and record in said Court, in accordance with law. In testimony whereof, I have hereunto set my hand and affixed the seal of said Court, at my office in Cherokee, in said County, on this 8th day of January A. D. 1901.

I, H. Heimsath do solemnly swear that I was acquainted with John Koth during his lifetime and that he departed this life at Diamond Twp. Cherokee County in the State of Iowa, on the 16th day of October A.D.1900.
